Educational platform for lawyers Legal High School invited partners of AGA Partners Ivan Kasynyuk and Irina Moroz to deliver speeches in the module "Raw Arbitration" in the School of Judicial Practice.

Ivan Kasynyuk presented the audience a practical look at English law through the commercial arbitration of GAFTA and FOSFA.

Ivan talked about the principles of international trade in agricultural products, he also focused on the role of GAFTA and FOSFA associations, their typical contracts and the reasons why such contracts are more often subject to English law. 

Irina Moroz presented the relevant legal positions of GAFTA and FOSFA to the students of the Legal High School.

Irina noted that, as a rule, trade in commodities is carried out within the associations of GAFTA and FOSFA, which work according to English law. The lecturer stopped on the terms of  GAFTA and FOSFA contracts, explained the scheme of disputes resolution, and also uncovered such phenomenon as an appropriation, which is a formal requirement of all contracts.

In support of the foregoing, Ivan Kasynyuk and Irina Moroz brought real cases to illustrate  the procedure for concluding a trade agreement and further arbitration proceedings.

 March 8 is behind, but the "women's day" continues.

According to the results of the research "Ukrainian Women i nLaw 2018", conducted by the team of the Legal newspaper, Aminat Suleymanova, managing partner of AGA Partners, is one of the most successful women lawyers in the Ukrainian legal business.

Aminat Suleymanova, Ivan Kasynyuk and Irina Moroz headed the Committees of Ukrainian Bar Association and held the first meetings of the Councils in AGA Partners office.

We decided to test this statement in practice, and the II Annual Conference of Agrarian Lawyers organized by ProAgro Information Company has become the platform for such a serious experiment.

Participants were given a unique opportunity to hear how some of Ukraine's best lawyers in the field of foreign economic activity, instead of usual speeches, analyzed several of the most important issues that Ukrainian companies exporting agrarian products face in their practice.

Iurii Gulevatyi, Associate at AGA Partners, acted as a moderator and speaker of the UBA Committee on Alternative Dispute Resolution meeting, dedicated to the specifics of the application of interim measures in international arbitration.

During the event, the participants discussed the criteria for the successful application of interim relief, as well as the recognition and enforcement of decisions of Emergency Arbitrators against sovereigns in investment arbitration proceedings.

Relocation of a child abroad is often a massive problem for parents. This issue was carefully considered by the participants of the meeting of the UBA Committee on civil, family and inheritance law.

Irina Moroz acted as a speaker and moderator of the discussion, during which the participants talked over the changes in judicial practice in determining the place of the child residence, the specifics of issuing a permit for the temporary relocation of the child abroad, the role of guardianship authorities in cases of the child's departure abroad.

The VI Judicial Forum of the Ukrainian Bar Association, the participants of which considered judicial reform and foreign experience, was recently held in Kiev. Partners of AGA Partners took an active part in the discussion.

How to trade under the new conditions for conducting international business activity?

Undoubtedly, trade in agrarian products has its own distinct features. There is a need for different approaches than in consumer markets, but the goal is the same: to get the maximum profit. Considering the growth of export volumes of Ukrainian agricultural products, more attention should be paid to the rules of the game on the international markets.

AGA Partners’ team successfully defends client’s interests in FOSFA arbitration.

$8.5 million - this was the amount of the Dutch company’s claim to our client. The subject matter of the dispute was the allegedly improper quality of the delivered agricultural products.

To the joy of our clients, a large Ukrainian agricultural holding, the arbitrators refused the claim in full. The last nail was the recognition of all counter claims of our client and compensation for legal and expert expenses.

Irina Moroz, Partner at AGA Partners, reveals the main ingredients of the victory:

“Everything is quite simple. Study 7 volumes of the complainant’s claims. Pore over the EU directives for a long time. Look for gaps and weaknesses in claims.

Apply the English law doctrines of satisfactory quality, fitness for purposes, quality final, etc. Add a dozen of expert opinions.

Cook it for 3 years, let it brew, add arguments to taste.

And, voilà, the FOSFA tribunal meets our claim in the first instance.

Irina Moroz, Partner, and Dmitry Koval, Associate at AGA Partners, have successfully represented client’s interests in GAFTA Appeal.

The case concerned a dispute as to whether there was a contract. The main goal was to prove the existence of a contract, as during a long negotiation and discussion, the market price for goods fell, and the defendant refused to sign the contract. Under the framework of English law, a contract can be regarded as concluded without the signatures of the parties, if they have formally agreed on the main provisions.

The Tribunal confirmed the conclusion of the contract, despite the absence of the parties’ signatures, and fully satisfied our client's claim for $1 million of default losses. The award was executed by the defendant by signing a settlement agreement.
